Raleigh Breach of Contract Civil Litigation Attorney
Maginnis Law regularly represents businesses and individuals in breach of contract cases. We are usually able to assist our clients regardless of whether the contract is written or oral. In many cases the filing of a lawsuit will compel the other party to come to the table and settle the matter. The firm can also review contracts and identify potential exposures to liability. If we are not able to compel settlement, we will aggressively litigate your case and attempt to recover the full value owed as well as interest. Unless the contract provides otherwise, you are typically entitled to 8% interest per annum from the date of breach until judgment. Interest can accrue at up to 18% if you are allowed to recover the maximum interest allowable by law. You may contact the civil litigation lawyers of Maginnis Law at 919.526.0450 to discuss your options under a particular contract or utilize our contact page to send a confidential new case inquiry.
Many people erroneously believe they cannot enforce their rights under an oral contract in a North Carolina Court but this is incorrect. Except for certain types of agreements, an oral contract is fully enforceable. You will be entitled to testify as to the substance of your agreement and may recover breach of contract damages if it is proven the defendant failed to abide by the contract.
Attorneys’ fees are generally not recoverable in a breach of contract case unless they are provided for in the contract itself. In many cases, even if attorneys’ fees are provided for the contract, they will be limited to 15% of the amount recovered.
